Welcome to MyKindofColor ("we," "us," or "our"). By accessing or using our website at mykindofcolor.com or the MyKindofColor mobile app (together, the "Service"), you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Acceptance of Terms

By using MyKindofColor, you confirm that you are at least 13 years of age and agree to these Terms. If you do not agree, please do not use our Service.

2. Use of Service

• You agree to use the Service for lawful purposes only.
• You will not upload images that you do not have the right to use.
• You will not abuse, spam, or attempt to reverse-engineer any part of the Service.
• Color matching results are approximate and for creative reference only.

3. Prohibited Content

By using MyKindofColor, you expressly agree not to upload, submit, share, or transmit any content that:

• Is sexually explicit, pornographic, X-rated, or contains nudity of any kind
• Is obscene, vulgar, offensive, or morally objectionable
• Depicts violence, gore, self-harm, or abuse of any kind
• Harasses, threatens, or intimidates any individual or group
• Contains hate speech or discriminates based on race, gender, religion, nationality, sexual orientation, or disability
• Exploits or endangers minors in any way
• Is illegal under any applicable local, national, or international law
• Infringes on the intellectual property rights of any third party
• Contains malware, viruses, or any harmful code

4. Intellectual Property

Photos you choose remain your property. In the app, photos are processed on your device to extract colors and are never uploaded to our servers. On the website, photos are sent to a third-party content moderation service (Google Cloud) to check for prohibited content, and are used only for that check and for color extraction. We do not store your photos after your session ends. Our platform, code, design, and product database are our intellectual property.

5. Accounts

Accounts are optional and included with a paid subscription. You are responsible for keeping your login details secure. You can delete your account at any time from within the app; deleting your account removes your synced palettes and stash.

6. Free Tier and Subscriptions

Your first month, starting from when you install the app, includes free color extraction and matching and up to 5 saved palettes. After that, free users get 3 extractions and matches per month, and palettes saved during the first month remain available.

A paid subscription ($3/month or $30/year) includes unlimited extraction and matching, unlimited saved palettes, an account, and sync between the app and website.

In-app subscriptions are billed through the Apple App Store or Google Play and renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage or cancel your subscription in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their policies.

Subscriptions purchased on our website are billed through Stripe and renew automatically until cancelled. You can cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.

We may change prices with advance notice.

Digital colors displayed on your screen may differ from physical products due to screen calibration, material properties, manufacturing variations, and lighting conditions. We recommend reviewing product swatches before purchasing. MyKindofColor is not responsible for any color discrepancies between digital representations and physical products.

9. Third-Party Products

Product information, pricing, and availability on our website are provided by third-party retailers (e.g., Amazon) and are subject to change without notice. We are not responsible for the quality, safety, or accuracy of third-party products.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We do not sell your personal data to third parties.

11. Limitation of Liability

To the fullest extent permitted by law, MyKindofColor shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including inaccurate color matches, third-party product issues, or service interruptions.

12. Changes to Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Service will be resolved exclusively in the state or federal courts located in Loudoun County, Virginia, and you consent to their jurisdiction. Before filing any claim, you agree to first contact us at mykindofcolorteam@gmail.com and try to resolve the dispute informally for at least 30 days.
